De acuerdo con la
decisión V/16 de la Conferencia de las Partes del CONVENIO SOBRE LA
DIVERSIDAD BIOLÓGICA celebrada en Nairobi (mayo 2000),
con el objetivo de promover la
aplicación del artículo 8 j) y disposiciones conexas del CONVENIO y
teniendo en cuenta los instrumentos estudiados en nuestro anterior trabajo,
este proyecto se propone llevar a cabo
los estudios adicionales
sobre métodos y
criterios que contribuyan a la preservación de los recursos genéticos, de
los conocimientos, innovaciones y prácticas tradicionales
asociadas y
que favorezcan el control por parte de los estados y
comunidades sobre la distribución de los beneficios y la conservación de los
recursos genéticos, de su capacidad natural de variabilidad y de su uso
sostenible, mediante:
1.
la creación de registros de conocimientos,
innovaciones y prácticas tradicionales de las comunidades indígenas y
locales (que entrañen estilos de vida tradicionales de importancia para la
conservación y la utilización sostenible de la diversidad biológica), y
posibiliten la protección de tales conocimientos y prácticas contra el uso
no autorizado.
2.
estructuras jurídicas que permitan
la inversión de esfuerzos tecnológicos y financieros ponderados de cada uno
de los aportantes (estados nacionales, comunidades locales e indígenas y
empresas comerciales) y su gestión conjunta. |
In agreement with the
decision V/16 of the Conference on the “CONVENTION ON BIOLOGICAL DIVERSITY”
(CBD), held in Nairobi, Kenya (May 2000), having as one of its goals the
promotion of extensive application of article 8 j), and related dispositions
of the CBD, and considering the instruments studied in our previous work,
this project is oriented to pursue additional studies on methods and
criteria which would contribute to the preservation of genetic resources,
knowledge, traditional innovations and associated practices. Also, it favors
states and communities control over the equal distribution of benefits
aroused from traditional knowledge and exploitations of biodiversity, as
well as promotes the conservation of the genetic resources, their natural
capacity of variability and sustainable use, through:
I. the creation of registries of knowledge, innovations and traditional
practices of the indigenous and local communities (involving traditional
lifestyles of importance for the conservation and the sustainable use of the
biological diversity), turning the protection of such knowledge possible,
and discouraging practices against their non authorized use.
II. The creation of legal structures that allows weighed investment of
technological and financial resources applied to the project by each one of
the investors (national states, local and indigenous communities, and
commercial companies) and their joint management. [See the attached

III. The creation of new financial and negotiable instruments which would
benefit the producers with access to funds at early stages of production
processes. |
